By entering an access password and entering any area of login.experiencepoint.com (including “ExperienceChange” and “ExperienceInnovation”, the user acknowledges this notice, and agrees to the terms and conditions, set out below.

Copyright

ExperienceChange and ExperienceInnovation and their component text, graphics, logos, button icons, images, audio clips, and software, is the property of ExperiencePoint and is protected by Canadian and international copyright laws. Your access to ExperienceChange and/or ExperienceInnovation is for personal use only. Any other use, including the reproduction, modification, distribution, transmission, republication, display, or performance, of the content on this site is strictly prohibited.

Trademarks

EXPERIENCEPOINT, EXPERIENCECHANGE, EXPERIENCEINNOVATION, and other ExperiencePoint graphics logos, and service names are trademarks of ExperiencePoint. ExperiencePoint’s trademarks may not be used in connection with any product or service that is not ExperiencePoint’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits ExperiencePoint.

Characters

All characters appearing in ExperienceChange and ExperienceInnovation are fictitious and any resemblance to real persons, living or dead, is purely coincidental.

Access Account

You have been granted individual permission to access ExperienceChange and/or ExperienceInnovation. The sharing of your access password is strictly prohibited.

Copyright Complaints

ExperiencePoint respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide the following to our agent for notice:

  • The name and identification of the copyrighted work you believe has been infringed.
  • The location in the product where the disputed material is located.
  • Your address, telephone number, and email address.
  • Your statement that you believe in good faith that the disputed material is not authorized by the copyright owner, its agent, or the law.
  • Your statement, made under penalty of perjury, that the information you are providing is accurate, and that you are authorized to act on behalf of the owner of the copyright involved.
  • Your physical or electronic signature or that of the person authorized to act on behalf of the copyright interest.

EXPERIENCEPOINT MAKES NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS OR IMPLIED, OF ANY KIND WITH RESPECT TO EXPERIENCECHANGE AND EXPERIENCEINNOVATION OR THEIR CONTENTS. EXPERIENCEPOINT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Termination of Access

In the event the user breaches these Terms of Use, permission to access ExperienceChange and/or ExperienceInnovation may be suspended or terminated by ExperiencePoint, in its sole discretion and without notice. Termination for breach of the Terms of Use shall be without refund.

Governing Law

ExperienceChange and ExperienceInnovation (excluding linked web sites as described above) is controlled by ExperiencePoint from its offices within the Province of Ontario, Canada. ExperienceChange and ExperienceInnovation can be accessed from all provinces and territories of Canada, as well as from other countries around the world. As each of these jurisdictions has laws that may differ from those of the Province of Ontario, by accessing the Web Site, the user agrees that all matters relating to access to, or use of, the Web Site, or any other hyperlinked web site, shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The user also agrees and hereby submits to the exclusive personal jurisdiction and venue of the courts of the Province of Ontario and acknowledges that the user does so voluntarily and is responsible for complying with local laws.

Business Conduct

ExperiencePoint provides several mechanisms that permit employees and non-employees to communicate confidential reports concerning business conduct. We value an environment characterized by transparency and candor. If you should have a concern about business conduct in your dealings with ExperiencePoint or an individual, we encourage you to share your concern directly with our team. However, should a sensitive situation emerge where it may be inappropriate or uncomfortable to openly address the matter, you may use the linked form to send an anonymous or confidential message to our leadership team. Your issue will be handled confidentially and with care. Please note that we are unable to action other types of communication through this form, such as customer support requests.
